Terms and Conditions for Golden Ticket Competition

  1. Introduction
    These Terms and Conditions govern the Golden Ticket Competition (the “Competition”)
    operated in Ireland and facilitated through Fundraising Solutions’ text line. By entering the Competition, participants agree to be bound by these Terms and Conditions.
  2. Eligibility
    a) The Competition is open to residents of the Republic of Ireland aged 18 years or older at the time of entry.
    b) Employees of MCD Promotions, Fundraising Solutions, their affiliates, agents, or immediate family members are not eligible to participate.
    c) Entrants must have a valid mobile phone number capable of sending and receiving text messages.
  3. How to Enter
    a) Participants enter the Competition by texting the designated keyword (as advertised) to the specified Fundraising Solutions text line.
    b) A standard donation amount (as advertised) will be deducted from the participant’s mobile phone credit or added to their mobile phone bill.
    c) Each valid text entry counts as one entry into the draw. A maximum of 6 entries per day are permitted; however, each entry requires a separate donation.
    d) Entries must be submitted within the Competition period as stated in promotional materials. Late or incomplete entries will not be accepted.
  4. Prizes
    a) The prize consists of a Golden Ticket, which grants the winner access to various MCD Promotions events as specified in the promotional material.
    b) The prize is non-transferable, non-exchangeable, and cannot be redeemed for cash or substituted for any other benefit.
  5. Winner Selection & Notification
    a) The winner will be selected at random from all valid entries using a computer-generated process ensuring fairness and compliance with applicable laws.
    b) The winner will be notified via text message or phone call within 5 days of the draw. If the winner does not respond within 10 days, an alternative winner may be selected.
    c) MCD Promotions reserves the right to verify the winner’s identity and eligibility before awarding the prize.
  6. Charity Contribution & Costs
    a) A portion of the proceeds from each text entry will be donated to the designated charity, as outlined in promotional materials.
    b) Standard network charges may apply to each text entry. Participants should check with their mobile service provider for details.
  7. Data Protection & Privacy

    a) By entering, participants consent to the processing of their personal data for the purpose of administering the Competition.
    b) Personal data will be handled in compliance with the General Data Protection Regulation (GDPR) and relevant Irish data protection laws.
    c) Participants may opt out of future marketing communications at any time by following the unsubscribe instructions provided.

  8. Liability & Disqualification
    a) MCD Promotions and Fundraising Solutions are not responsible for technical malfunctions, lost entries, or network failures beyond their control.
    b) Any attempt to manipulate or interfere with the Competition will result in immediate disqualification.
    c) MCD Promotions reserves the right to amend, suspend, or terminate the Competition in exceptional circumstances beyond its control.
  9. Governing Law
    These Terms and Conditions are governed by the laws of Ireland, and any disputes arising shall be subject to the exclusive jurisdiction of the Irish courts.

    a) A clear breakdown of funds raised and distributed will be made available upon request to comply with transparency obligations under the Charities Act 2009.
    b) The charity will ensure that all funds received through this Competition are used solely for the intended charitable purposes as stated in promotional materials.
    c) Fundraising Solutions shall provide regular reconciliations of text donations and issue payments within a reasonable timeframe.
  13. Tax & Legal Considerations
    a) Donations made via text entry may not qualify for tax relief under Irish tax law. Entrants should consult with a tax professional if required.
    b) The charity is not responsible for any tax obligations arising from winning the Competition.
  14. Complaints & Dispute Resolution
    a) Any complaints regarding the Competition should be directed to MCD Promotions in the first instance.
    b) If the issue is related to charity donation processing, complaints may be escalated to Fundraising Solutions or the relevant regulatory body.
    c) The charity reserves the right to withdraw from the fundraising campaign if legal, regulatory, or reputational concerns arise.
